Question
My husband inherited his brothers gun. The gun is in IL. We live in AZ. Our son is moving to AZ from IL & we want to know if it is possible for him to bring the gun in their trunk. Is there any forms or anything he would need to do this?
Answer
There's no way one person can keep up on the patchwork of gun laws from state to state. The Federal McClure-Volkmer Act. Makes the provision that one can transport a gun from anywhere in the US it can be legally had to anywhere in the US it can be legally had.
If your husband lived in IL and your brother gave him the gun and he then moved to AZ, this would mean that he could transport it there.
You will have to check with someone in IL what is required to leave the state with a gun, and with someone in AZ what is necessary to enter the state with a gun (not the transport of it, but moving it's "home" from one place to the other). There is likely no restriction on the gun in AZ (2nd Amendment attorney Scott Kappas gives AZ a 99% rating for gun friendliness; he rates IL at 30%).
However, as an example of what can happen, CA law is written such that there is no way to legally leave the state with a gun. If you move from CA, you have to pretty much sell or surrender you guns. Most people simply ignore this, as once the gun is out of the state CA has no jurisdiction, and gun-friendly states don't care if people move from CA with their guns or not.
This is not an endorsement or a recommendation to do so, just an observation of what many people do in dealing with such states.
