Question
I抦 trying to get my CCW in Minnesota, but I had a gross misdemeanor(conceal without a permit) almost 11 years ago,no jail time just 6 months of unsupervised probation because of a clean background I was told it wouldn't affect me as long I didn't had the same or similar ,now the sheriff department is telling me that I been denial because 揑抦 a danger to myself and my community and likely to do it again? so I would say that抯 the purpose of the permit to legally carry and not do it again illegally . I know I can get my record expunge after 3-5 years after the incident but It will still show to law enforcement my question is. If the word 揕IKELY?is a legal ground to denied a CCW or how can I get around, as to me likely is not a certainty? Thank you
Answer
Raul,
In Minnesota, the Sheriff has broad discretion in issuing concealed carry permits when someone has a criminal record. The Sheriff may deny you a permit if they believe that "there is a substantial likelihood that a person would be a danger to themselves or others if issued a permit to carry".
What it looks like is happening is that the Sheriff where you live may have a policy of denying permits to persons that have previously committed crimes involving violence or crimes involving firearms.
If you wish to continue to pursue it, you might consider contacting an attorney in MN to see what other options you might have. They should be able to tell you if the expungement would make a difference or not.
Sorry I don't have better news for you...
