Can you appeal tag-up rule after a dead ball?

Runners on 1st & 3rd, one out. Batter hits a line drive, runner go on contact, shortstop makes a diving catch and throws to third for a double play as runner crosses home plate the ball is missed by the third baseman and rolls out of play, dead ball, does the appeal rule is no longer in play for the third out and the run counts?

Hi Earl,
During a dead ball a runner must be given the opportunity to complete their base running responsibilities. Returning to a base left too early must occur prior to an award. The umpire should hesitate in making the award while watching what the runner does. If the runner shows no intention of returning then the umpire should make the award. Once the umpire awards the bases and if the runner reaches the 1st base of the award and then for any reason retreats to the previous base, it is an illegal act. The defense may appeal and the umpire should rule the runner out.
Ok all this means, ball goes out of play, "DEAD BALL".........what is R1 doing? Starting to head back to 3rd, ok we let them and then make the award.
If R1 left the field of play before attempting to return they may not return and the umpire would honor an appeal right then.
R1 is not doing any movement back to 3rd or has left the field of play, make the award "R1 is awarded home and R2 is awarded 3rd. Since R1 has already touched home and is now not allowed to return, the defense can then appeal for the out.
If there is no appeal, there is no out
