Question
Batter gets a base hit misses first base continues to second base on his way to third retreat back to first base  runner is tag while standing on first for being off his legal base wich should be second base true or false

Gerald,

To avoid being put out on appeal for missing first base, the batter must return to first base.  So no, the batter/runner is not in jeapordy of being put out while standing on first base.  In fact, standing on first base in your scenario is the only place she can be to absolutely avoid being put out.  I don't think that you will find the word "legal" in the rule book when referring to the base a batter/runner is on.  

If the batter/runner stayed at second or third, they could not be tagged out while on the base.  But, if a proper appeal was made for missing first, and the umpire agreed, then the batter/runner could be put out that way.
