Question
If a team is being accused of using "hot" or "loaded" bats but is still using them and the league is not having them checked under ASA Rules, what are the consequences if the bat is found to be altered. Furthermore, what are the consequences if a player is hit while the batter is using the alleged "hot" bat and badly injured? Thankyou in advance. Your help is greatly appreciated.

Hi Stevie,
leagues make their own rules (some ban players for a year or more) but in ASA tournament play a player using an altered or banned bat is called out and ejected from the tournament.
I'm no lawyer (though I just slept at a Holiday Inn Express visiting my Marine son just back from the Middle East) but if I was hurt by an altered or banned bat, let's say MEAN, NASTY, OBNOXIOUS L A W Y E R and I would SUE that player until the cows come home.
gross negligence
n. carelessness which is in reckless disregard for the safety or lives of others, and is so great it appears to be a conscious violation of other people's rights to safety. It is more than simple inadvertence, but it is just shy of being intentionally evil. If gross negligence is found by the trier of fact (judge or jury), it can result in the award of punitive damages on top of general and special damages.
