during a co-ed slowpitch softball game a batter hits a long hit and in running the bases he catches up with the runner on first as they are coming home they are together with the hitter ahead of the other but he waits for the runner from first to touch home first ( as with all bases)is he out? and at what point is he out is it when he physically becomes ahead of the other runner in the opinion of the umpire?

Yes, the batter-runner would be called out for passing the runner, and this call would be made by the umpire as soon as the batter-runner physically passes the runner from first.
The ball is not dead, and any remaining runners may advance, or retreat, at their own peril.
